Airlines to be "Squeezed": Draft Law Banning Carriers from Setting Hand Luggage Rules Submitted to the State Duma

The initiative aims to combat "unfair abuse" by airlines

A bill has been submitted to the State Duma that could prohibit airlines from independently setting hand luggage rules. The initiator is Senator Ayrat Gibatdinov. The document has already been posted in the Duma's electronic database.

The rules on the dimensions and weight of hand luggage are already prescribed in aviation legislation, and carriers do not have the right to establish additional rules for which a fee is charged. The adoption of the law is aimed at combating the "unfair abuse" by airlines of the right to arbitrarily set the dimensions of hand luggage.

On June 6, the Shcherbinsky Court of Moscow ruled that the airline "Pobeda" must increase the size of hand luggage. The prosecutor's office claims that the company is abusing its rights by creating the appearance of choice for passengers when setting the minimum possible dimensions. The plaintiff noted that the established rules are aimed at circumventing the law and infringe on the rights of passengers.

"Pobeda" pointed out contradictions in aviation rules. In particular, clauses 133 and 135 of FAP No. 82 contain different requirements. On the one hand, the carrier is obliged to ensure the safe placement of hand luggage. On the other hand, it is allowed to carry additional items without taking into account their weight and dimensions.
