The St. Petersburg AGR plant, which previously belonged to the Korean automaker Hyundai, is trying to challenge the decision of the St. Petersburg Customs in court. Disagreements between the parties arose due to the import of components for the assembly of Hyundai SOLARIS, Hyundai Creta and KIA RIO cars into the country. The company's complaint will be considered by the 13th Arbitration Court of Appeal.
Various trademarks are affixed to auto components. Manufacturers receive remuneration from brand owners for their use. This remuneration must be included in the cost of imported parts, which in turn is subject to customs duty.
The documents governing the relationship between the car factory and foreign car manufacturers mention about ten trademarks, such as ACCENT, HYUNDAI, SOLARIS and others.
For example, license fees in favor of Hyundai motor company for the second half of 2020 amounted to $15.4 million, and for the first half of 2021 — $14.5 million.
In May 2023, the St. Petersburg Customs conducted an audit of the correctness of payment calculation and found that the AGR automobile plant underpaid 397.4 million rubles. Penalties in the amount of 96.2 million rubles were charged on this amount.
In March of this year, the car factory appealed to the Arbitration Court of St. Petersburg and the Leningrad Region, which recognized the actions of the customs as legal and justified.
Earlier, "Avtozavod St. Petersburg" registered a new trademark. The new logo is an image of a bridge that is being raised, enclosed in an ellipse. This sign will be used to mark various vehicles and related products manufactured at the factory.
