An Omsk resident won a lawsuit to replace a new Lada Vesta car with a manufacturing defect from the car dealer R-Motors LADA LLC. For extraneous noise in the suspension, the man received not only a new car, but also more than 2.3 million rubles.
Within 15 days of purchase, the man discovered serious defects: extraneous noise, beating, and rattling in the area of the front wheels at various speeds. On June 13, 2024, he contacted the dealer with a request to replace the car he had purchased from them for 1.8 million rubles, believing that the defects critically affect the safety and handling of the vehicle.
R-Motors LADA LLC refused to satisfy the client's request, citing the fact that no malfunctions were detected during its own inspection.
An examination was conducted during the trial. Experts concluded that the noise and dull knocking in the car were caused not by operational damage, but by a manufacturing defect. The Omsk Regional Court, having considered the dealer's appeal against the decision of the Pervomaisky District Court of Omsk, agreed with the conclusions of the experts and the court of first instance and considered the presence of a factory defect in the car proven.
Thus, the plaintiff achieved the replacement of the Lada Vesta car with a manufacturing defect with a new one of the same brand, model, color and configuration. From the car dealer R-Motors LADA LLC, funds in the total amount of over 2.3 million rubles were recovered in favor of the plaintiff. This amount included a penalty for a long delay in fulfilling the legal requirements of the consumer, compensation for moral damage and a fine.
