The FAS has announced a transition period: until the end of 2026, companies will not be held liable for placing advertisements on Telegram and YouTube. This time is given so that the market has time to adapt to the new rules.
The essence of the changes is related to the law "On Advertising." It is emphasized that it is forbidden to place advertisements on resources that are restricted in Russia. Information about such restrictions comes from Roskomnadzor and is considered by the FAS.
Regarding the facts of advertising on Telegram and Youtube, the FAS analyzes the content of the advertisement, the date of the contract, the date of the introduction of restrictions on the platform's operation, the date of publication of the advertisement, the grounds for its placement, including contracts and payment orders.
The FAS explained that businesses need time to adapt to the new rules and switch to other advertising channels. That is why, until the end of 2026, liability measures for advertising on Telegram and YouTube will not be applied.
At the same time, monitoring compliance with advertising legislation when placing messages on platforms that were previously restricted will continue. This refers, in particular, to Instagram* and Facebook*, as well as VPN services.
