AO "Tutaevskaya PGU" demanded to recover 488.9 million rubles in damages from ODK-Gazovye turbiny due to the delay in the construction of a 52 MW combined cycle thermal power plant. The plant was supposed to be commissioned by the end of November 2019, but it actually started operating only in October 2020.

However, a forensic examination found that "Tutaevskaya PGU" did not meet the requirements to obtain permission to sell electricity in the wholesale market.

Because of this, from December 1, 2019, to October 2, 2020, the TPP could not operate in the wholesale market in the mode intended for it. The actual fuel costs of the plant turned out to be 128.8 million rubles higher than with the optimal operating model in the wholesale market.

VEB.RF, which financed the construction and was involved in the case as a third party, supported the claim but estimated the amount of damages at 294 million rubles. The court also ordered "Tutaevskaya PGU" to pay ODK-GT 14.7 million rubles for expert examination costs. The decision can be appealed.
