A bill has been developed in the State Duma aimed at the mandatory recovery of CMTPL insurance payouts from those responsible for road accidents, especially in situations involving aggravating circumstances. This concerns cases related to deliberate crashes or driving a vehicle while intoxicated.
It is proposed that the Bank of Russia collect and publish data on recourse claims across the country. Insurers, in turn, would be required to file such claims in certain situations, for example, when the person at fault acted intentionally or was intoxicated.
Recourse is a demand by an insurance company to reimburse losses that have already been paid out. According to the explanatory note, in 2023 and 2024 insurance companies did not exercise their right to recourse claims against unscrupulous drivers in the amount of 5.7 billion rubles.
The authors of the bill note that the lack of financial receipts from such car owners leads to higher insurance rates for all clients, which may cause social tension. According to the deputies' plan, the new rule will eliminate cases in which insurers voluntarily refuse to recover funds from unscrupulous drivers.
