What to do if money is stolen from a bank card

Blocking the card, filing an application with the bank and contacting the police are three steps to recover stolen funds

If money is stolen from a bank card, it must be blocked immediately, and then contact the bank and the police, said Denis Talyzin, a lawyer at the Interterritorial Bar Association "Klishin and Partners".

Blocking the card through a call to the bank or through the application will help avoid further losses. After that, you should submit an application to the bank for unauthorized withdrawal of funds with a request to cancel the transactions and return the stolen money.

According to the law, the bank is obliged to return the funds if the theft was reported no later than the next day after the suspicious transaction and the client did not violate the security rules, for example, did not provide card details to third parties.

It is also important to contact the police department at the location of the bank office where the account was opened. There you need to write a detailed statement about theft or fraud. Law enforcement officers will consider it, initiate a criminal case and take action.

After the initiation of a criminal case, you can file a civil lawsuit to recover the stolen funds from the persons to whose account the money was transferred, on the basis of unjust enrichment. A similar claim should be filed with a court of general jurisdiction. These procedures are different, but serve one purpose - to return the stolen funds.

To improve security, the lawyer advises to never provide the full card number, expiration date, CVC/CVV code and codes from SMS, connect SMS notifications about all transactions and set limits on payments by card.
