"Ufaneftekhim" to Receive 255 Million Rubles from the Enterprise as Compensation for Expenses Incurred During the Construction of Workshops and Buildings

The company "Ufaneftekhim" will receive 255 million rubles from the Far Eastern shipyard "Zvezda" as compensation for expenses incurred during the construction of workshops and buildings. The shipbuilders were not satisfied with the quality of the work and parted ways with the contractor, subsequently achieving a sixfold reduction in compensation for them.

"Ufaneftekhim" was engaged in the construction of a hull production block, a boiler house, painting chambers, and a mechanical assembly workshop. The company wanted to receive 1.5 billion rubles from "Zvezda," but the Fifth Arbitration Court of Appeal issued a different decision on June 11, reducing the amount. Now the parties have two months to appeal.

The proceedings regarding "Ufaneftekhim's" expenses began in 2021, while the contracts for the construction of the shipyard's facilities were concluded in 2018-2019. The contractor was supposed to carry out work on the painting chambers and hull production block, the steam-generating boiler house, the mechanical assembly workshop, and the block assembly workshop. The total cost of the work exceeded 6 billion rubles, but in 2020, "Zvezda" unilaterally terminated the contract with "Ufaneftekhim."

The contractor did not dispute the termination of the contract itself but demanded compensation for the expenses incurred and payment for the work done. The total amount of claims amounted to 1.5 billion rubles. In November 2020, the Arbitration Court of the Primorsky Territory considered "Ufaneftekhim's" claims to be fair.

However, "Zvezda" refused to pay, believing that the contractor had performed some of the work so poorly that the cost of correcting the deficiencies outweighed both the little that had been done and the associated expenses incurred by the company.

"Zvezda" is the leading enterprise for the repair of submarines of the Pacific Fleet and the only one in the Far East specializing in the repair, conversion, and modernization of nuclear submarine missile carriers.
