Owners of Telegram channels and blogs will be required to pay 3% of advertising revenue each quarter. The rule applies to all communities, regardless of the number of subscribers. The penalty for violating the new law can reach 500 thousand rubles. This was announced by Elena Grin, Chairman of the Union of Legal Bloggers and Deputy Head of the Department of Intellectual Rights of Moscow State Law University named after O. E. Kutafin.
The new law applies not only to channel owners, but also to advertising distributors, advertising system operators, their intermediaries and agents who have entered into a direct agreement with the advertiser or an intermediary agreement with the agent.
If a blogger or author of a Telegram channel distributes advertising, he is an advertising distributor and must pay a mandatory three percent fee, regardless of the number of subscribers. Advertisers do not pay.
Grin also noted that in case of non-payment of the advertising fee within 10 days from the date of receipt of a special notification, a recovery procedure will be initiated. Fines can reach up to 500 thousand rubles.
The amendments come into force on April 1 of this year.
