The legal battle between Uralvagonzavod Concern (UVZ, part of the Rostec Group) and the Ministry of Industry and Trade has ended. What Happened
In 2015, the Ministry of Industry and Trade allocated funds to Uralvagonzavod to compensate for the performance of research, development, and technological work within the framework of an investment project.
According to the plan, the enterprise was to develop a unified tracked platform with an electromechanical transmission and a hybrid power plant for harsh operating conditions - in the Arctic climate.
In accordance with the agreement, by the end of 2021, UVZ was to produce and implement five "world-class technologies" and 200 units of products, obtain six patents for inventions and trade secrets, and create 110 high-performance jobs.
What Went Wrong
The Ministry of Industry and Trade demanded that UVZ return the money, as the listed target indicators could not be achieved, and then even went to court. The Arbitration Court in Moscow rejected the claim in December 2024.
At that time, the instance agreed with the defendant's arguments about the impossibility of obtaining the expected results for reasons beyond UVZ's control and due to the impracticality of continuing the work. The court placed the costs incurred by the plant on the customer.
Case Review and Court Decision
In April 2025, the Court of Appeal overturned the decision of the first instance and satisfied the claim. The court took into account that Uralvagonzavod's information letters with justification for the impossibility of achieving the target indicators were sent to the department in 2022-2023, that is, after the end of the project implementation period.
As a result of the appeal, over 106 million rubles of unjust enrichment and 10 million rubles of fine on top were recovered from the enterprise.
At the same time, the court satisfied the claim for the fine only partially - the plaintiff demanded about 80 million. In August, the Arbitration Court of the Moscow District agreed with the appeal.
