The Arbitration Court of St. Petersburg and the Leningrad Region recovered 30 million rubles in penalties from the TBS machine tool plant for violating the delivery deadlines of equipment. The lawsuit was filed by Kurganmashzavod.
Initially, the company demanded 50 million rubles, but the court partially reduced the amount of recovery.
The parties signed the contract in the summer of 2023. The manufacturer undertook to supply two horizontal boring machines with numerical control model PR522F4. The equipment is designed for processing parts weighing up to 40 tons. The order was intended for the needs of the defense industry.
Under the terms of the agreement, the machines were to be transferred to the customer in a year. However, by the summer of 2024, the delivery had not taken place. The Kurgan enterprise agreed to extend the deadlines. The parties signed an additional agreement and postponed the deadline for the execution of the contract until mid-2025.
In April 2025, the customer terminated the contract unilaterally. The total value of the contract exceeded 556 million rubles. After the termination of the agreement, the company demanded to pay a penalty for the delay.
Representatives of the machine tool plant stated in court that the delay was due to problems with the supply of components. The company was unable to purchase the necessary parts for the assembly of equipment in time. The court considered these arguments insufficient and ordered the manufacturer to pay compensation.
