The Arbitration Court of Primorsky Krai has ordered the Arsenyev Aviation Company (AAC) \"Progress\" to pay more than 100 million rubles to the Scientific and Production Enterprise (NPP) \"Zvezda\" named after Academician Severin. The dispute arose from the non-payment for the supply of components for Ka-52M \"Alligator\" attack helicopters.
According to the case materials, the enterprises entered into a contract for the execution of a state contract with the Ministry of Defense of the Russian Federation. NPP \"Zvezda\" supplied products for Ka-52M helicopters, but the Primorsky plant \"Progress\" did not make payment within the established time frame.
The plaintiff demanded the recovery of 93.3 million rubles of principal debt and 18 million rubles of penalty, with subsequent accrual until the moment of actual payment. The court confirmed the fact of product delivery and recognized the claims of \"Zvezda\" as legitimate.
The defendant did not present objections on the merits and explained that it could not fulfill its obligations due to the lack of funding under the state defense order. Nevertheless, the court considered these arguments untenable and ordered the recovery of the entire amount in full.
