The Arbitration Court of the Moscow Region has rejected the claim of ZIO-Podolsk Engineering Plant (part of Rosatom Group) to recover over 400 million rubles in penalties for a disrupted pipeline supply. The court decision was made on August 29.
In total, the Rosatom enterprise demanded half a billion. However, it will receive only 70 million rubles in compensation for losses.
In 2021, the parties agreed on the supply of vacuum steam pipelines and related parts for a total amount of 339.3 million rubles. The manufacture of equipment for plants for the thermal treatment of solid municipal waste in the Moscow region was allocated 11 months, but the supplier did not meet this deadline.
Only part of the order for 99.2 million rubles has been completed - one of the four ordered steam pipelines. The rest were not produced due to the lack of necessary materials.
The reason was the shortage of certain types of metal products previously supplied from the Azovstal Iron and Steel Works. This concerned steel products used for the production of vacuum steam pipelines. A quick replacement for the materials was not found in the country, which led to a shift in all production deadlines.
Later, the customer changed the technical specifications, concluded an agreement with another supplier, and in June 2024 actually agreed to terminate the agreement with Atlant, subject to adjusting the schedule for the return of funds. However, a few months later, ZIO-Podolsk demanded not only compensation for losses of 99.2 million rubles for equipment that cannot be used for its intended purpose, but also a penalty for delaying the execution of the contract for 405.6 million rubles.
The court satisfied the claim on the main claim of ZIO-Podolsk only in terms of compensation for losses of 69.8 million rubles and state fees for consideration of the case, and refused to recover the penalty. On the counterclaim of PTO Atlant, the arbitration court ruled on the complete termination of the supply contract.
Earlier www1.ru reported that the amount of lawsuits against the manufacturer of TOS-2 "Tosochka" reached 300 million rubles.
