A former contractor won a lawsuit against Admiralteiskie Verfi for 400 million. The shipyard estimated this amount as the damage from changing the contractor to complete the main slipway and outfitting shop.
Admiralteiskie Verfi and Intex entered into a contract for the construction of two spans of hull "D" of slipway and outfitting shop No. 12 for 902.3 million rubles in September 2020. In January 2022, Admiralteiskie Verfi terminated the contract unilaterally, justifying the decision by the failure to complete the work on time.
To complete the shop, the shipyard held a new tender, following which SK Unit LLC received the contract in December 2022. At that time, the work already cost approximately 1.1 billion rubles.
Admiralteiskie Verfi decided to recover 393.2 million from the rejected contractor: the difference between the cost of work in the new contract and the price of work in the terminated contract, which the shipyard estimated at 675.2 million.
The shipyard's lawyers called the new contract a replacement for the terminated one, but the judge of the St. Petersburg Arbitration Court got the impression that the new contract was not at all like the old one, and that Intex had long owed nothing to Admiralteiskie Verfi.
