The State Transport Leasing Company (GTLK) is once again at the center of a lawsuit due to delays in the delivery of unmanned aerial vehicles (UAVs). This time, Roskadastr has filed a claim for 19.7 million rubles, which is almost ten times more than the previous claim of 2.13 million rubles.
The conflict is based on the violation of UAV delivery deadlines, which were to be handed over to the customer. This time, the third party in the process is "GC Quiet Wings" (Kalashnikov).
To involve the LIMITED LIABILITY COMPANY "QUIET WINGS GROUP OF COMPANIES" (198095, ST. PETERSBURG, CHEMICAL LANE, D. 1, LITERA AV, ROOM 13-N, OFFICE 40, OGRN: 1207800024662, OGRN Assignment Date: 02/21/2020, TIN: 7802703755) as a third party not asserting independent claims.
Earlier, the court ruled that GTLK was obliged to pay a penalty of 2,138,948 rubles 16 kopecks, despite attempts to shift responsibility to the drone manufacturer, Geoscan.
In the review, the defendant argues that the untimely delivery of the goods to the Plaintiff under the Agreement occurred through the fault of LLC Geoscan (hereinafter - the Third Party), with whom the Defendant concluded a separate agreement for the supply of unmanned aerial vehicles dated 05/29/2024 No. 24-203-GTLK to ensure the fulfillment of obligations under the Agreement. The Third Party untimely fulfilled its obligations to the Defendant for the supply of unmanned aerial vehicles stipulated by the agreement dated 05/29/2024 No. 24-203-GTLK, which caused the Defendant's failure to fulfill its obligations to the Plaintiff. Meanwhile, this argument cannot serve as justification for exempting the defendant from paying penalties.
The court hearing is scheduled for September 4, 2025.
