Court Sides with Yaroslavl Shipyard in Dispute with Ministry of Defense

The Russian Ministry of Defense failed to challenge the court decision to exempt the Yaroslavl Shipyard from fines for delayed delivery of an order. The appellate instance upheld the decision of the Moscow Arbitration Court of March 3, 2025, which denied the department's claim against PJSC "Yaroslavl Shipyard".

Under a 2020 contract, the Yaroslavl Shipyard built two dredgers for dredging operations for the Russian Ministry of Defense at a total cost of 3 billion 544.4 million rubles. The first vessel was to be delivered in 2021, the second in 2022. The customer received both dredgers approximately 2 years late for each vessel and decided to penalize the shipyard for the delay in fulfilling the contract.

The initial claim for recovery was 129.6 million rubles, but then the Ministry of Defense increased its demands to 1.099 billion rubles. In refusing to grant them, the court pointed out to the plaintiff both errors in the calculation of penalties and its actions that contributed to the delay in the acceptance of the order.

Also, the penalty for state contract executors is completely written off if it does not exceed the limits established by the government. Thus, in this particular case, the shipbuilding enterprise should not pay anything.

The Yaroslavl Shipyard also produces Project 20221 boats for the benefit of the Pacific Fleet.
