Perpetrators of accidents may be deprived of their driver's licenses for refusing to compensate for damage

A bill has been submitted to the State Duma on the deprivation of driver's licenses for evading compensation for damage caused as a result of a traffic accident. The initiator was Deputy Sardana Avksentyeva, Deputy Chairman of the Committee on State Construction and Legislation.

The current legislation allows restricting the right to drive a car if there are debts for alimony and criminal claims. However, compensation for damage from an accident is not included in this list. According to Avksentyeva, this allows the perpetrators of accidents to freely use the car, despite the court decision that has entered into force.

The parliamentarian pointed out that drivers from among migrants and socially vulnerable categories most often resort to evading payments. Such debtors, as a rule, do not own property and do not have official income. They use other people's bank cards, rent cars or register them to third parties, avoiding civil liability.

Many of these drivers deliberately refuse to issue an OSAGO policy. As a result, accident victims do not receive compensation either through insurance or through judicial recovery. This violates the principle of justice and undermines confidence in the system of protecting citizens' rights.

According to the bill, the measure of deprivation of a driver's license will be applied only if the amount of debt is 100 thousand rubles or more. Such a threshold allows maintaining a balance between liability measures and protecting the rights of debtors with minor obligations, the author of the initiative believes.
