State Duma Deputy Yaroslav Nilov has proposed changing the rules for compensation of damages in accidents committed under aggravating circumstances. The bill he introduced proposes to obligate the perpetrators to compensate the injured party without fail. Currently, insurance companies can seek funds from the perpetrators through the courts after paying the injured party.
Nilov considers the driver's intoxication, lack of a driver's license, and fleeing the scene of an accident as aggravating circumstances. Although insurance companies have the right to recourse claims in such cases, they do not always exercise this right.
Nilov is confident that mandatory recourse claims will help avoid situations where conscientious drivers are forced to cover the costs of accidents caused by others. Such a measure of responsibility for offenders will contribute to a more effective recovery of damages, which could reduce the time for proceedings by 40% and increase their effectiveness to 90%, the parliamentarian believes.
