A contract concluded under the influence of fraud may be declared invalid

Scammers, posing as bank employees or technical support services, fraudulently gain remote access to citizens' smartphones to issue loans to them. This was reported on August 24 by Vladimir Filatov, Chairman of the Moscow Bar Association "Capital".

The attackers persuade users to install programs for remote access to the device and enter confidential data in mobile banking applications. Once they gain control, they use the information to issue loans.

As the lawyer explained, according to civil law, such a loan agreement concluded under the influence of fraud may be declared invalid. However, financial organizations often dispute this, pointing out that the client independently entered confirmation codes and had access to the device.

To challenge such transactions, Filatov recommends collecting evidence of fraud. These include records of telephone conversations, screenshots of correspondence, witness statements, and the results of an examination of activity in the personal account.

As a preventive measure, the lawyer advised connecting notifications about all transactions in banking applications and regularly checking your credit history.
