The Arbitration Court of St. Petersburg has rejected the Krylov State Research Center's (GNTs) claim to recover 91.7 million rubles in penalties from the Baltic Shipyard for delaying payment for the electric propulsion systems for the icebreaker "Arktika" Project 22220. The final payment of 84.4 million rubles was transferred only after the successful completion of ice trials in June 2023.
The conflict arose from a 405-day payment delay related to the failure of the propulsion electric motor in 2020. This incident became the subject of a separate legal dispute between the insurer and the Krylov State Research Center, where the issue of compensation for 240 million rubles in damages is being resolved.
At the time the penalty was calculated, the plaintiff had already received 95% of the contract price. The disputed payment, according to the statement of claim, amounts to 84,427,524.99 rubles, that is, 5% of the contract price. However, the amount of the penalty was calculated by the plaintiff not from the disputed payment, but from the entire contract price, which is more than the amount of the disputed payment.
The Krylov State Research Center has one month to appeal the decision in the appellate court.
