KamAZ demanded a subsidy from the Ministry of Industry and Trade for conducting foreign trade activities. The subsidiary Foreign Trade Company "KAMAZ" submitted the application 18 minutes after the deadline and was rejected. Now the parties will try their luck in court.
The subsidy of 346 million rubles, which caused the dispute, applied to 2023 and was provided by the "Russian Export Center" for the sale of domestic products abroad, with funds allocated through the Ministry of Industry and Trade.
Faced with the refusal, the automaker appealed it in court, but the Foreign Trade Company "KAMAZ" has still not received the subsidy. On April 21, the Moscow Arbitration Court ordered the Ministry of Industry and Trade to pay the company 346 million rubles, and the department has one month to appeal the decision.
The terms of receiving the subsidy, published by the Ministry of Industry and Trade, stated that applications would be accepted until 6:00 PM on August 20, 2023. The application from "KAMAZ" arrived 18 minutes late, but the court decided that the "daughter" is still entitled to the subsidy.
The Arbitration Court of the Moscow District, referring to the Civil Code of the Russian Federation, indicated that in this case, the acceptance of applications should end on the next business day, that is, August 21.
