The United Press Service of the St. Petersburg Courts reported a case where a Russian citizen won a lawsuit and received more than 34 million rubles for a defective Genesis car.
The buyer purchased a 2018 car on the secondary market in November 2021 for 2.98 million rubles; at the time of purchase, a four-year warranty from the manufacturer was in effect.
During the third year of the warranty period, defects were discovered during the operation of the car that prevent its full use, namely: the rear left seat adjustment buttons failed, the airbag error light came on, and the trunk does not always open with the button and key. Korogod contacted an official dealer to carry out warranty repairs for various defects.
After 35 days (more than the required 30 days) of repairs at the official dealer, the car was returned to the owner (December 30, 2021) supposedly in good condition, but during the holidays, the rear left seat stopped adjusting again. The man turned to the service center again, but he was told that he would have to wait. After that, the plaintiff filed a lawsuit.
The court recovered from Ellada Intertrade LLC in favor of Korogod the cost of the car in the amount of 2,980,000 rubles, losses in the form of the difference in the cost of [new and used] cars 10,998,000 rubles, a penalty for delay in satisfying the requirement to return the cost of the goods in the amount of 8,500,000 rubles, a penalty for delay in satisfying the requirement to return the cost of the goods in the amount of 0.5% of the cost of the corresponding goods 15,740,000 rubles for each day of delay until the date of execution of the court decision, compensation for moral damage in the amount of 50,000 rubles, a fine in the amount of 11,264,000 rubles, expenses for paying for the assessment of the market value of the car in the amount of 8,000 rubles, expenses for paying for a judicial examination in the amount of 26,000 rubles, expenses for paying for a repeated judicial examination in the amount of 100,000 rubles, expenses for paying for the services of a representative in the amount of 60,000 rubles, expenses for paying state fees in the amount of 45,500 rubles.
