Rosreestr proposed to allow the placement of data center equipment in buildings on plots with any type of permitted use, without introducing a separate land category. The draft order was published on September 21, and discussions will continue until October 6.

Currently, various codes are used for data centers: "Communications," "Warehouses," "Administrative and Business Management," "Scientific and Production Activities." This creates different requirements for plots and different payment amounts. In the Moscow region, the rental coefficient for the "Communications" category has increased from 1.1 to 75 since the beginning of the year. An operator risks recalculation and penalties if the municipality determines that a data center is operating in a warehouse.

Rosreestr refers to the Civil Code: data center equipment is movable property, and it can be placed in any premises. Introducing a new type of permitted use would require revising urban planning documentation and EGRN data, which would delay projects. The industry insists: without a separate code, legal uncertainty and recalculation risks will persist.
