Legislative enshrinement of the concepts of "cyber risk" and "cyber incident" will help create a full-fledged insurance product to protect clients from cyber threats. This was stated by Senator Artyom Sheikin.
A round table was previously held in the Federation Council, where legislative regulation of cyber risk insurance was considered in the context of the large-scale digitalization of the economy. According to Sheikin, participants in the event spoke about formalizing new concepts in law, without which judicial practice is impossible.
It is proposed to supplement the law "On the Organization of Insurance Business" with a separate type of insurance — insurance against cyberattacks, with a description of the possible scope of coverage.
In addition, senators are discussing amendments to the law on the security of critical information infrastructure and allowing insurers to sell cybersecurity audit services. The idea of creating a state reinsurance pool (a group of insurance companies for jointly covering risks under highly loss-making contracts) is also being considered, Sheikin concluded.
