Transportation company received two speeding tickets with a difference of 22 seconds

The Supreme Court (SC) has recognized that drivers can be penalized multiple times for speeding using cameras, even if they are located a few hundred meters apart.

A transportation company from Voronezh appealed against two fines received for speeding by a bus. The fines were issued with a difference of only 22 seconds. According to the ruling of May 4, 2023, a public transport driver exceeded the speed limit by 25 km/h in the center of Voronezh, for which he received the first fine of 500 rubles at 9 hours 6 minutes 48 seconds, the second fine by camera was issued at 9 hours 7 minutes 10 seconds.

Referring to the law, the company insisted that it is impossible to punish twice for the same violation. The company's lawyers tried to prove their case in the judicial instances of the Voronezh region, but the arguments did not work. Then they reached the Supreme Court, where Judge Sergei Kuzmichev decided that these were different violations, since the registration took place on different sections of the road.

Expert Grigory Shukhman emphasizes that the installation of cameras at such a short distance may threaten road safety. He pointed out the need to take into account the distance between the cameras so that drivers can slow down without creating emergency situations.

The founder of the project "Overheard at the DPS" Valentin Ilyinov added that such an installation of cameras creates difficulties for drivers, actually turning the road into a "trap".

In fact, we are dealing with the so-called trap on the road, when it is fundamentally difficult for drivers not to get a fine.
