Samara-based company "RMI-Stal" (a subsidiary of the Acron Group) has filed 4 lawsuits with the Arbitration Court of St. Petersburg against the Baltic Shipyard since the beginning of 2025. The reason is the delay in payments for the metal received by the company for the construction of Project 22220 icebreakers.
Details are known for one of the lawsuits. In particular, the contract signed in March 2024 between "RMI-Stal" and the Baltic Shipyard provided for the supply of a batch of copper cathodes. The contract amount was 246.6 million rubles.
The shipbuilding company paid only 180.3 million rubles for the received metal. The management of Acron's "daughter" planned to recover the balance of 66.3 million rubles from the plant, as well as 10.6 million rubles in penalties and 4 million rubles in interest.
However, after the start of the trial, the Baltic Shipyard paid the remaining 66.3 million rubles. As a result, the judge only recovered the penalty from the shipyard, and refused to recover the interest. The court decision was published on October 2, and it has not yet entered into legal force.
The penalty itself is a financial sanction for violation of an obligation, in connection with which the accrual of interest leads to non-compliance with the principle of proportionality of responsibility to the consequences of the violation of the obligation.
There were other disputes between "RMI-Stal" and the Baltic Shipyard this year. The total amount of claims from the metal supplier to the company for 4 lawsuits amounted to 199.2 million rubles.
The Arbitration Court of St. Petersburg has made a decision on 3 disputes, 1 decision has entered into legal force. The process is not completed for the fourth lawsuit. The participants in the litigation refrained from commenting.
