The Property Relations Department of the Altai Territory failed to sue the company "Shin-TEK" for a complex of production buildings and structures located in one of the industrial zones of Barnaul. Regional authorities claimed that the properties were completely lost and beyond repair. However, "Shin-TEK" was able to prove otherwise.
On July 11, the Arbitration Court of the Altai Territory ruled against the region's claim to recognize the company's ownership of the disputed industrial facilities as non-existent. This decision may be appealed.
Altai officials stated that "Shin-TEK" had no rights to eight buildings with a total area of 5.4 thousand square meters, as well as railway tracks with a length of about 2.3 kilometers. However, federal agencies and an independent examination confirmed the legality of the company's rights to these facilities.
The key argument in defense of "Shin-TEK" was that the disputed property is necessary for the implementation of the state defense order. The company is managed by JSC "Roskhim", authorized to perform administrative functions at a number of enterprises related to the production of aircraft tires for military and civil aircraft.
To consolidate assets, JSC "Production Association "Altai Tire Plant"" was established, which acquired shares in the authorized capital of these commercial structures. As part of the analysis of enterprises, factors negatively affecting the implementation of the state defense order were identified, and investments in the amount of 23.2 billion rubles are required. "Roskhim" plans to restore the "Shin-TEK" facilities to increase production capacity in the interests of the country's defense capability.
A representative of the Altai Tire Plant noted that the Military-Industrial Commission under the Government of the Russian Federation confirmed the need for the plant to acquire ownership of the disputed facilities. They will be used in the implementation of the state defense order for aircraft tires.
Earlier, www1.ru reported that aircraft manufacturers in Russia were threatened with external management for failure to fulfill a state contract.
