The Supreme Court of the Russian Federation has issued a ruling stating that it is illegal for a driver who is waiting for a traffic police officer after an accident to consume alcoholic beverages.
This conclusion was made in connection with the case of a resident of Karelia, who in March 2023 was found guilty of violating Part 3 of Article 12.27 of the Administrative Code of the Russian Federation ("failure to comply with the requirements prohibiting a driver from consuming alcoholic beverages after a traffic accident to which he is involved"). For this, he was fined 30 thousand rubles and deprived of his rights for 1.5 years.
The case file notes that Ivanov was driving a car that belonged to his acquaintance. The man drove into a ditch, as a result of which the car overturned and was seriously damaged. While the driver was waiting for a traffic police officer, he consumed alcoholic beverages. The court deprived him of his rights for this and fined him.
Despite the lack of claims from the car owner, the courts ruled that such actions violate the law, and refused to satisfy Ivanov's appeal.
