The Arbitration Court of Moscow denied the Ministry of Industry and Trade of Russia's claim for 619.2 million rubles in penalties from OOO Rusal Taishet Aluminum Plant. The ministry filed the lawsuit on March 17, and on September 29, the court ruled to dismiss the claims.

Information about the dispute is contained in the arbitration case materials. Earlier it was reported that the Ministry of Industry and Trade demanded 619.2 million rubles in penalties from the Taishet Aluminum Plant. However, the specific obligation for the violation of which the ministry accrued this amount is not disclosed in publicly available materials. Therefore, it is impossible to establish its connection with a specific investment project or other obligation without the case materials.

The defendant is OOO Rusal Taishet Aluminum Plant, which is part of the Rusal group. The enterprise is located in the Irkutsk region. The first stage of the plant was launched in 2021, with a capacity of 428.5 thousand tons of aluminum per year.

The court dispute itself is not related to another Rusal case at the FAS. In July, the Federal Antimonopoly Service initiated a case against the group for failing to comply with a warning to adjust the aluminum pricing formula for the Russian market.

The decision of the Arbitration Court of Moscow has not entered into legal force. It can be appealed within one month after the decision is made. If the materials of the next instance reveal the basis for calculating the penalty, the content of the dispute will become clearer.
