A one-and-a-half-year-old girl accidentally placed an order for 102 items totaling 139 thousand rubles in a marketplace application. Her mother noticed the mistake and immediately tried to cancel everything but was refused. After several years of proceedings, a Moscow court recognized the platform's actions as illegal and ordered it to refund the woman's money.
The case had previously been heard in courts. The cassation instance sent it for a new review. As stated in the materials, the child accidentally pressed the order button when there were 102 items in the cart.
The woman immediately contacted the marketplace and asked to cancel the purchase. However, she was refused, with the explanation that the goods had already been transferred for assembly and shipment. After the storage period for the order at the pickup point expired, the platform debited money from her bank card and set a negative balance in her personal account.
The dispute continued for several years, but in the end, the court sided with the buyer. It indicated that the woman immediately exercised her right to withdraw from the contract even before the goods were delivered to the pickup point. The marketplace's refusal was recognized as a violation of the Law "On Protection of Consumer Rights".
The platform was ordered to pay the cost of the order, compensation for moral damages, a fine, and notary fees. The press service of the Moscow City Court clarified that the total cost of 102 items amounted to 139 thousand rubles.
The decision has not yet entered into force and may be appealed.
