Новосибирский завод получил некомплектное оборудование из Великобритании и отсудил почти 190 млн рублей

The company was supplied with British furnaces, but they lacked critical components

JSC "Novosibirsk Plant of Semiconductor Devices Vostok" achieved the return of the advance payment and the payment of penalties for imported furnaces. The equipment was delivered to the customer in an incomplete technical set, which made its operation impossible.

In 2020, the plant, through an intermediary, the Moscow company "SKTO Promkomplekt", ordered three furnaces for the diffusion of semiconductor wafers of the British brand Thermco.

Until the fall of 2022, the equipment was stored in its original packaging in the warehouse of JSC "Novosibirsk Plant of Semiconductor Devices Vostok", as the production facilities had not yet been prepared for its installation.

However, after unpacking the goods, a shortage in the delivery was discovered. The buyer did not check the contents, because, on the one hand, they trusted the supplier, and on the other hand, there was a verbal agreement between them that critical components for starting the furnaces would be delivered later, when the plant equipped the location for their placement.

By the end of 2022, Russian industrialists and equipment suppliers from abroad began to experience the full force of Western sanctions. In this regard, it was not possible to complete the furnaces from the UK with original components. The Vostok plant went to court to protect its interests and won.

According to the court decision, "SKTO Promkomplekt" will return to the buyer the cost of the equipment, 138.8 million rubles, as well as a penalty, interest, fine and court fee for a total amount of 49.4 million rubles.
