The Ninth Arbitration Court of Appeal upheld the decision of the Arbitration Court of Moscow to recover 97 million rubles from PJSC Kaluga Turbine Plant (KTZ) in a lawsuit filed by JSC Power Machines. The information appeared in court documents on the official website of the institution.
Initially, Power Machines sought more than 658 million rubles in penalties under the contract dated August 26, 2021, and about 31 million rubles in damages. The penalty was charged for the delay in fulfilling obligations for the supply and installation of hydro unit equipment.
The court of first instance recognized the losses as confirmed by another judicial act but reduced the amount of the penalty to approximately 66 million rubles, considering the claimed amount disproportionate. The appeal court upheld this decision.
KTZ is the main manufacturer of OK-90A-1 Azurit and OK17-M Mirage steam turbine units for Project 955 Borei and Project 885M Yasen-M nuclear-powered strategic missile submarines.
