Nevsky Shipbuilding and Ship Repair Plant won a dispute with the Finnish Wärtsilä regarding a contract for the supply of marine engines for dry cargo ships worth 2.3 million euros. Now Wärtsilä Finland Oy subsidiary must return 618 thousand euros to Nevsky Shipyard.
The company will have to return the unworked advance payment for diesel generators intended for four RSD59 project dry cargo ships, which Nevsky Shipyard is building for Pola Rise under the order of the State Transport Leasing Company (GTLK).
The contract for the supply of diesel generators for 2.3 million euros was signed between Wärtsilä Finland Oy and Nevsky Shipyard in April 2017. The amount of 618 thousand euros corresponds to the cost of supplying equipment for the last of the four vessels, designated in the documents as "order 595".
Representatives of the Finnish company tried to transfer the dispute to the Arbitration Institute of the Stockholm Chamber of Commerce. This was indicated in one of the clauses of the contract. However, the judge refused to grant this motion, referring to federal law 171-FZ, concerning the protection of the rights of individuals and legal entities in the context of restrictive measures imposed by a foreign state.
General Director of Nevsky Shipyard Evgeny Kuznetsov did not answer the question of how it is planned to recover money from the subsidiaries of the Wärtsilä group. Wärtsilä also did not provide comments on the execution of decisions of St. Petersburg courts on the recovery of unworked advances for the supply of equipment for Russian shipyards.
