Laws that simplify opting out of spam calls come into force in September

New laws that will help quickly get rid of annoying spam calls will come into force in September. However, even now there are ways to stop spammers and fraudsters, according to Andrey Moiseev, Associate Professor of the Department of Civil Law Disciplines at the Plekhanov Russian University of Economics.

The fight against telephone spam, which lasted for many years, ended with the adoption of a new law — N 41-FZ of April 1, 2025. It will come into force in September and will protect everyone who suffers from telephone fraud.

From September, a new article 44.1-1 will be added to the law "On Communications." Now, customers of mass calls are required to obtain prior consent from subscribers. Previously, such a norm also existed, but now it will be possible to refuse intrusive calls through the operator, without wasting time arguing with the company.

When applying for another card at a bank or store, the buyer can transfer the right to notify about promotions not only to the seller, but also to his partners. Now, the subscriber has the right to notify the mobile operator of the refusal to receive mailings, and the operator will be obliged to stop calls and SMS.

The customer of mass calls needs to conclude an agreement with the operator and take into account the wishes of subscribers who do not want to receive calls. The law also regulates the transfer of a phone number to family members and close relatives.

Before September, you can complain about advertising calls or messages to the Federal Antimonopoly Service, Roskomnadzor, or directly to the telecom operator. The procedure depends on the type of call. If there are signs of fraud, the application will be transferred to the Ministry of Internal Affairs. Issues related to advertising are under the jurisdiction of the FAS, Moiseev noted.

Earlier, the Ministry of Internal Affairs of Russia warned about the increase in telephone fraud aimed at teenagers. During the holidays, fraudsters often try to gain access to their parents' accounts through their children.
