The FAS has published a draft resolution clarifying the criteria for defining online advertising on marketplaces, search engines, and aggregators. These changes supplement the amendments to the advertising law, which introduce a mandatory levy of 3% on income from online advertising.
The new rules define online advertising as ads on marketplaces, search engines, and aggregators. At the same time, reference and informational materials and advertisements not related to entrepreneurial activity are not subject to taxation. Internal promotion of goods on marketplaces will also be subject to a 3% levy, which may increase costs for platforms and the cost of advertising.
The proposed changes will affect more than 7 million individual entrepreneurs and legal entities, with the exception of television and radio broadcasters, news agencies, and media with state participation.
MTS, in turn, believes that the bill does not offer new criteria for online advertising. They are all already contained either in the advertising law or in previous clarifications from the FAS.
Since September 1, 2022, Russia has had mandatory labeling of online advertising and the sending of data on advertising campaigns to the Unified Register of Internet Advertising of Roskomnadzor.
