Что делать при ДТП с велокурьером службы доставки: главное правило

Couriers are not covered by compulsory motor third-party liability insurance, but you can claim damages through the court

If a car and a scooter or e-bike are involved in an accident, several important steps need to be taken. This was stated by Egor Lysoy, head of the retail loss settlement center at SberStrakhovanie.

It is imperative to call the traffic police to officially register the incident. If the accident occurred on the road, the procedure is standard: stop, turn on the hazard warning lights, and set up a warning sign. If there are any casualties, call an ambulance.

According to the source, a collision with a scooter rider is considered a full-fledged accident. Legally, it does not matter whether the car was moving or parked.

It will not be possible to register an accident involving a scooter under the Europrotocol (without involving traffic police officers), since the compulsory motor third-party liability insurance policy does not apply to couriers. However, the injured party has the right to demand compensation in civil proceedings. This is similar to the situation with an accident caused by a driver without a compulsory motor third-party liability insurance policy.

If the courier working for a specific company was at fault in the accident, the injured party can demand compensation from the company. The employer is responsible for the actions of the employee if he was performing his duties.

According to the expert, it is usually easier and faster to receive compensation from a company than from an individual.

Earlier, an analogue of compulsory motor third-party liability insurance was proposed for electric scooters. Compulsory liability insurance for owners and users of electric scooters will be an important step towards improving road safety. This innovation will protect all road users and ensure compensation for damage in the event of an accident, according to Artyom Sheikin, First Deputy Chairman of the Federation Council Committee on Constitutional Legislation and State Building.
