The Novorossiysk Transport Prosecutor's Office demands to ban the "Black Sea Association for the Development of Yachting Tourism and Sports" (Navetru sailing club) from conducting recreational sea trips in Gelendzhik. According to the supervisory authorities, the transportation of tourists on sports yachts is carried out illegally and poses a danger to the lives of passengers.
In July 2024, during one of the trips in Gelendzhik Bay, the yacht Raya sank, resulting in the death of a woman, while the remaining passengers were rescued. The yacht captain, Ilya Khafizov, and the founder of the club, Konstantin Murugov, became defendants in a case of providing services that do not meet safety requirements (Part 2, Article 238 of the Criminal Code of the Russian Federation). The trial is taking place in the Gelendzhik City Court.
During the investigation, it was established that the yacht trip, which turned into a tragedy, was оформлена as a course on ship management training. It turned out that the "Black Sea Association," owning 8 yachts of the MX-700 class, does not have a license for educational activities. Also, the association does not have permission to transport passengers.
The Prikubansky District Court of Krasnodar, where the transport prosecutor's office appealed, agreed with the arguments of the supervision, confirming that the Navetru sailing club is only allowed to operate in the field of sports — that is, participation in competitions. However, the regional court, after considering the complaint of the yacht owners, who were not involved in the proceedings, overturned the decision of the first instance. Currently, the case is under reconsideration.
