"Il" PJSC has been trying for five years to recover funds under a state contract with "308 Aircraft Repair Plant" JSC (Ivanovo), concluded in 2020 for the maintenance of military transport aircraft. The courts have sided with the aircraft manufacturer, but the funds have not yet been returned. This is reported by Mashnews.
The contract involved an advance payment of 614 million rubles, but subsequently the volume of ordered work decreased, and the plant had to return 244.3 million rubles. The money was not received on time: part of the amount (100 million) was returned with a delay, the rest was not.
The Arbitration Court of the Moscow District on October 10, 2025, upheld the decisions of lower courts: 186.4 million rubles, including interest and legal costs, are to be recovered from the enterprise.
Experts note that the situation is complicated by the financial difficulties of the plant, which operates in the field of state defense orders. It is possible that the case may go to bankruptcy.
The cause of the conflict was the use of an unused advance payment for purposes other than intended — the money from the special account was spent on other needs, which is prohibited by the rules of the state defense order. However, the court did not establish signs of bad faith on the part of the defendant: details of the expenditure of funds may be examined already within the framework of a possible bankruptcy procedure.
According to experts, the situation shows the risks of the state contract advance payment system, when contractors receive large prepayments without sufficient guarantees of the return of funds. In such cases, only a bank guarantee or an independent pledge helps, but there were none in this contract.
"Il" PJSC won the lawsuits in the case, but the receipt of funds remains in question — the financial situation of "308 ARP" JSC remains difficult, and the execution of the decision may take years.
