FAS Initiated a Case Against the Construction Company After Numerous Complaints From Residents

The Federal Antimonopoly Service (FAS) of Russia has initiated a case against the developer PIK. The case includes the communications operator "Lovit" and management companies of residential complexes in Moscow, Moscow Oblast, and St. Petersburg. The basis is the restriction of access for other providers to the infrastructure of the buildings.

The FAS inspection began in the spring of 2025 following numerous complaints from residents. According to the agency, organizations within the PIK group did not provide access to networks for alternative communications operators. This concerned residential complexes in four regions: Moscow, Moscow Oblast, St. Petersburg, and Leningrad Oblast. Complaints were received from March 2025, when an incident occurred in PIK buildings involving an internet outage. During that period, the provider "Lovit" was subjected to a DDoS attack, which led to network failures. Residents were left without an alternative, as other providers were not allowed access to the infrastructure.

The FAS determined that such restrictions affect the interests of apartment owners and impact competition in the internet access services market. The agency sent requests to ten major providers, including MTS, "MegaFon," and "Rostelecom," to collect data on obstruction of access to the network. The inspection confirmed the presence of violations under paragraph 9 of part 1 of article 15 of the Federal Law "On Protection of Competition."

If the facts are confirmed, the developer faces administrative fines under the Code of Administrative Offenses. The amount of fines for legal entities can reach 15 percent of the revenue received from the violation.

PIK is one of the largest developers in Russia, specializing in the construction of apartment buildings. In 2024, the company put into operation more than 3 million square meters of housing. Antimonopoly cases in the housing sector are conducted regularly to ensure equal access to services.
