The sale of licenses for mineral deposits on online platforms such as Avito is not provided for by Russian law. This was reported by the Ministry of Natural Resources of the Russian Federation.
Companies cannot sell licenses for deposits, but there are cases when a license can be transferred during the reorganization of a legal entity or under a production sharing agreement.
On Avito, you can find ads for the sale of companies that own such licenses, as well as shares in them.
For example, one of the users of the online platform is selling a placer gold deposit in the Primorsky Territory for 350 million rubles and a 75% stake in a diamond deposit in Yakutia for 600 million rubles. For 30 million rubles, it is also proposed to buy 25% in a phosphorite deposit in the Kirov region, where development is already underway with the production of fertilizers. The ads indicate that either companies owning the license or shares in such companies are being sold, but not the licenses themselves.
This was confirmed by one of the sellers, who said that the deal would be formalized through the sale of an LLC, the owner of the licenses. The registration of licenses after changes in the structure of the company must be carried out in accordance with the law.
The Avito platform clarified that it does not participate in the process of оформление сделок and only checks ads for compliance with legislation and its rules. The оформление сделок, including the re-registration of licenses, takes place outside the platform and must be carried out by competent authorities.
