ЕАЭС Board to Refine Rules for Importing Cars from the Union

The Board of the Eurasian Economic Commission (ЕАЭС) has postponed the entry into force of new customs clearance rules for cars by one year — until April 1, 2025. The reasons cited are the need to refine information systems and avoid negative consequences for businesses. Industry experts predicted that after the new rules came into effect, cars imported from the ЕАЭС into Russia would cost significantly more than they did before.

On March 26, the Board of the Eurasian Economic Commission, at the proposal of the member states, changed the effective date of a number of Board decisions from April 1, 2024, to April 1, 2025, regulating customs legal relations regarding the filling of the transit declaration, the declaration for goods, as well as the application of structures and formats of individual customs documents.

As a reminder, from April 1, 2024, when importing cars into Russia from ЕАЭС countries, buyers would have to pay the state all underpaid taxes and fees for the car when paying the recycling fee, since the customs value of imported cars is underestimated due to the use of a "gray" scheme. It looks, for example, like this: for a car purchased in Kyrgyzstan, 2,000 euros of customs duty are paid, although in fact, according to the tariff grid, 12,000 euros must be paid for the car.

After the implementation of the new rules, the introduction of which has been postponed to next year, buyers of cars from Kyrgyzstan, Kazakhstan, and other ЕАЭС countries will have to pay customs duties, VAT, and excise tax.

For control, it was planned to create a risk management system (СУР). Through it, ЕАЭС customs officers will have to monitor the flow of imported goods from Kazakhstan, Kyrgyzstan, Armenia, Belarus, and Russia. Thus, cars purchased under "gray" schemes should have become significantly more expensive when imported into Russia.
