Google has once again failed to challenge the collection of a large sum. The Arbitration Court of the Moscow District rejected the cassation appeals of Google International LLC and Google Ireland Limited and upheld the decisions of the two previous instances. As a result, approximately 160.3 billion rubles are to be collected from the Irish entity into the bankruptcy estate of the bankrupt OOO "Gugl".
The story began after the Russian Google entity filed for bankruptcy in June 2022. In 2023, the company was declared bankrupt and bankruptcy proceedings were initiated. Bankruptcy trustee Valery Talyarovsky began searching for funds that could be returned to the bankruptcy estate to settle with creditors.
One such dispute involved payments from Russian OOO "Gugl" to Google Ireland. The bankruptcy trustee challenged agreements between the companies and transactions conducted from April 1, 2018, to March 3, 2022. The total amount of disputed payments was approximately 373.8 billion rubles.
The court ruled that Google Ireland should pay 101.7 billion rubles, as well as 58.6 billion rubles in interest for the use of funds as of October 24, 2025. Moreover, interest on the principal amount must continue to accrue until the actual return of funds. Therefore, the final amount of the collection may increase in the future.
The Moscow Arbitration Court declared the relevant agreements and payments invalid and on March 3, 2026, ruled to collect the money. Google Ireland Limited and Google International LLC tried to appeal it, and on June 4, the Ninth Arbitration Court of Appeal upheld the decision.
Now, the Arbitration Court of the Moscow District has conducted its review. It also found no grounds to overturn the previous decisions. Presiding judge Elena Korotkova explained that the decision of the Moscow Arbitration Court and the appellate ruling should be left unchanged, and the cassation appeals should be dismissed.
During the proceedings, the court involved the Russian Prosecutor General's Office and Rosfinmonitoring. This was due to the fact that the trustee's statement mentioned the possible withdrawal of assets from Russia.
Google has lost at the third level of dispute resolution. Meanwhile, the story surrounding the bankruptcy of OOO "Gugl" continues. The bankruptcy trustee is also trying to hold Google's foreign entities and a number of related parties liable for subsidiary liability.
