The court ruled to recover 9.8 million rubles from the Scientific Production Center "Elvis" in favor of LLC "Lukoil-Kubanenergo" for violating the delivery terms of the "Polyana" anti-drone complexes for the Krasnodar TPP, according to the case materials.
The contract for 100 million rubles for the supply of equipment was concluded back in 2023. The maximum delivery time expired on June 27, 2024, but the first complex arrived at the TPP only at the end of November. Lukoil demanded to recover the maximum penalty — 10% of the contract value. The court fully satisfied the claim, ordering NPC "Elvis" to pay 9,486,814 rubles of penalty and 309,604 rubles of state duty expenses.
The defendant has not provided and the court has not established any evidence confirming the obvious disproportionality of the penalty to the consequences of the breach of obligations.
The developer's problems do not end there. The company is facing another court, this time with another Lukoil division — LLC "Lukoil-Yugnefteprodukt" for the amount of 14.2 million rubles, writes the Telegram channel "Bespilot". The outcome of the case is predictable, since "Elvis" has already lost similar disputes to Lukoil — including paying a penalty for disrupting supplies to a facility in the Kaliningrad region.
