Moscow Resident Wins Over 3.4 Million Rubles from Dealer for Defective Car

An unusual case occurred in Moscow where a buyer won 3.4 million rubles from a dealer for a defective "Moskvich 6." The story began in March 2024 when a resident of the capital purchased a new liftback. Immediately after receiving the car, he encountered a problem: the gearbox was malfunctioning. Despite attempts to fix the problem, including repairing and replacing the transmission, the issue was not resolved.

The buyer decided to go to court after spending 92 days waiting for repairs. The court of first instance granted his claims and ordered the payment of 3,424,725 rubles, although the initial cost of the car was 1.7 million rubles.

In addition to returning the amount for the car, the court ordered the dealer to pay additional compensation. Specifically, 100 thousand rubles for the penalty, 400 thousand rubles for the delay in returning funds, 25 thousand rubles for moral damages, 45 thousand rubles for losses, and a fine of 1.135 million rubles. The state fee amounted to 19.7 thousand rubles.

Thus, although the plaintiff initially demanded 11.5 million rubles, his claims were partially satisfied. Both parties to the dispute, both the buyer and the dealer, disagreed with the court's decision and filed an appeal.

Currently, the "Moskvich 6" with a CVT costs from 2,136,000 to 2,530,000 rubles, and there are still 2023 models in stock. This case highlights the importance of protecting consumer rights and demonstrates that even in difficult situations, justice can be achieved.
