A bill has been developed in Russia that provides for the possibility of processing biometric personal data of suspects, accused, and convicted persons without their consent. The document is planned to be considered at the next government meeting.
The initiative is not new: the Ministry of Justice published a similar draft back in 2024. At that time, the agency explained the need for changes by the absence of a direct norm in the legislation allowing penitentiary institutions and detention centers to process biometric data of these categories of persons without their consent.
In general, the processing of biometric personal data requires a person's consent, but the legislation provides for cases where such processing is allowed without consent. The Unified Biometric System is used for legally prescribed tasks of identification and authentication of citizens.
Biometric data includes information about a person's physiological and biological characteristics, on the basis of which their identity can be established, including fingerprints and voice.
