Pricing for intellectual property in Russia will gain a transparent mechanism. As reported by TASS in the government, a digital service for calculating the average royalty rate will be operational by July 2027. The tool will cover inventions, utility models, industrial designs, trademarks, and computer programs.
The service will essentially become an online calculator for the market value of rights. Professor Beniamin Shakhnazarov of the O.E. Kutafin Moscow State Law University (MSAL) explained: the algorithm will analyze price dynamics, industry specifics, and the database of license agreements registered with Rospatent. This will free the market from situations where even a conscientious rights holder cannot justify the price, and a license buyer cannot verify its adequacy.
For businesses, the main impediment to commercializing developments – the unpredictability of costs for formalizing rights – disappears. A startup purchasing a technology license will be able to incorporate the payment into its financial model in advance, and the patent holder will be able to set a justified price. Currently, valuation often turns into an expensive expert assessment, which negatively impacts the speed of transactions. The new service should shift the focus from bargaining to objective market indicators.
