The dealership company "Forward-Auto" will compensate a resident of Perm 4 million rubles for a defective Lada Granta, which is 5.5 times the original price of the car at 860 thousand rubles.
The buyer, who discovered serious defects — including malfunctions of power windows and hub bearings — went to court. An examination by the court of first instance confirmed the presence of manufacturing defects, after which the car was returned to the dealer, and the claims were satisfied.
The dealer's representative offered to execute the decision — to return the funds to the consumer, and the car to the salon. And not just return, but also remove the pledge, pay off the loan.
However, during the trial, Forward-Auto tried to put pressure on the buyer, threatening criminal prosecution for possible fraud. The court ordered a second examination, which did not reveal any defects, but lawyers proved that this happened under pressure from the dealer.
In this case, the judges had to compare many facts preceding and accompanying the trial in order to ultimately make the right decision.
As a result, the court sided with the buyer, obliging the company to pay 4 million rubles.
