In the event of a proven causal relationship between health deterioration and the operation of a cell tower, residents can claim compensation of one million rubles and also initiate the demolition of the tower. This was stated by the head of the State Duma Committee on Property Issues, Sergei Gavrilov.
According to the deputy, residents can contact Rospotrebnadzor and the Prosecutor's Office. If a link is established between health condition and the operation of the tower, it is possible to obtain compensation of one million rubles or more, and also initiate the demolition of the structure at the expense of the local administration or the company responsible for the construction of the tower.
Gavrilov added that the demolition requirement is also relevant in cases where neighbors have leased a plot of land for the installation of a cell tower. In such situations, residents can prove that it harms their health due to radiation and devalues their property. The deputy noted that land plots in the residential sector are not intended for the construction of such facilities, and the presence of a tower may serve as a basis for its demolition.
If local authorities have approved the construction of a tower that negatively affects health, they will have to compensate operators and developers for the loss of profits due to the demolition. Gavrilov also pointed out that the presence of cell towers near residential properties leads to a decrease in their value.
Gavrilov noted that such properties may cost 8-20% less than average market prices, and in some cases, the cost may be halved. This circumstance provides grounds for appealing to the court and law enforcement agencies, without waiting for the results of medical examinations on health deterioration.
