They Will Fight Back: Bill on Punishment for Theft and Defamation Using Deepfakes Submitted to the State Duma

Such crimes may be punishable by imprisonment for up to two years

A bill has been submitted to the State Duma proposing to introduce a qualifying element in several articles of the Criminal Code in the form of the use of deepfake technologies. For defamation using the voice or image of the victim, as well as when using his biometric data, it is proposed to punish with imprisonment for up to two years, arrest for up to three months, or a fine of up to 1.5 million rubles.

Fraud using deepfakes may, in particular, be punishable by a fine of up to 400 thousand rubles or imprisonment for up to six years.

The bill proposes to amend the articles of the Criminal Code of the Russian Federation "Causing property damage by deception or abuse of trust", "Fraud in the field of computer information", "Extortion", "Theft" or "Defamation".

The authors of the initiative emphasized that attackers had previously forged photographs for selfish purposes, but modern technologies, including artificial intelligence and neural networks, make it possible to create fakes that are almost impossible to distinguish from real ones. They also make it possible to reproduce other biometric data.

For its part, the government proposed to finalize the bill. The government's review of the document notes that the use of identity substitution technologies has not yet been regulated in legislation.
