The Supreme Court of Russia has ruled in favor of a citizen who, in a dispute with a well-known bank, was able to benefit from a system failure. The court recognized as lawful the profit-making from currency transactions as a result of a bank's system error.
This decision is precedential, it will set the direction of judicial practice. It should be emphasized that the law imposes increased responsibility on professional participants in business transactions. The Supreme Court of Russia adheres to such legal positions. The decision will be studied and analyzed by the legal community.
In February-March 2022, bank employees mistakenly set the wrong exchange rate. During the conversion, the rate differed greatly from the market rate and became very attractive to bank customers.
Many managed to take advantage of the situation and multiply their financial assets. Later, when the error was discovered, the accounts of people who played on the difference in the erroneous exchange rate were blocked.
After the account was blocked, one of the clients went to court. The decision was made in his favor, and the bank was ordered to return 68 thousand euros that had been debited.
It is good that the court in this situation sided with the client, and not with the strong. It is quite reasonable that the bank itself, and not the consumer of its services, will pay for its operational errors.
According to experts, the bank had no right to freeze clients' accounts due to its own errors.
